Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Maghraut PMS software, website, and related services (“Services”) provided by Maghraut Technologies Pvt Ltd (“Maghraut”). By creating an account or using the Services, you agree to these Terms.

1. Account registration and subscriptions

You must provide accurate information when creating an account. Subscriptions are billed according to the selected plan and billing cycle. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

2. Acceptable use

You agree to use Maghraut PMS only for lawful hotel operations. You may not attempt to bypass access controls, scrape data without authorisation, upload malware, or use the platform to send spam or harass others. Misuse may result in suspension or termination.

3. Data ownership and responsibility

You retain ownership of the data you enter into the platform. You are responsible for ensuring you have the right to collect and store guest data, including identity documents, in accordance with applicable laws. Maghraut acts as a processor and provides tools to help you manage that data securely.

4. Service availability

We aim for high availability and provide daily backups. However, the Services are provided on a best-effort basis. Scheduled maintenance, factors outside our control, or force majeure events may affect availability. We are not liable for downtime caused by third-party services or your own network conditions.

5. Fees, refunds, and cancellations

Fees are charged in advance based on your plan. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are handled according to our Refund Policy.

6. Limitation of liability

To the extent permitted by law, Maghraut’s liability is limited to the amount paid for the Services in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages arising from use of the platform.

7. Termination

Either party may terminate the agreement with notice. Upon termination, we will retain data only for the period required by law or our backup retention policy, after which it will be securely deleted. You are responsible for exporting any data you wish to keep before closure.

8. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.
